The
government is considering the 'significant recommendations' put
forward after a review by Lord Justice Jackson. The proposed overhaul
would see lawyers taking a share of damages as opposed to a 'success
fee' paid by the defendants. Furthermore, the share of damages
lawyers can take will be capped at 25% with a 10% rise in damages
awarded to ensure claimants are still properly compensated.
The
review was commissioned in 2008 to investigate the rising cost
of civil litigation. The reforms seek to streamline the process,
reducing costs payable by the defendant and increasing the amount
of compensation that reaches the claimant. A less expensive process
is likely to see an increase in the number of civil litigation
cases of which slips, trips and falls already make up a large
proportion. |
